Acceptable Use Policy
This policy defines the acceptable and prohibited uses of all ServerMili services. All customers, resellers, and end-users must comply with this policy at all times.
Effective Date: 1 January 2024 | Last Updated: 1 January 2024
This Acceptable Use Policy ("AUP") is an integral part of ServerMili's Terms of Service. By using any service provided by ServerMili, you agree to comply with this policy. Violation of this AUP may result in suspension or termination of services without prior notice.
1. General Conduct
You are responsible for all activities conducted through your account, whether performed by you, your employees, your customers (if you are a reseller), or any other party who gains access to your services. You must:
- Use our services only for lawful purposes and in compliance with all applicable laws of India and the jurisdiction from which you operate.
- Ensure that all content hosted on your account does not violate any applicable local, state, national, or international law.
- Maintain current and accurate contact information in your account at all times.
- Respond to abuse complaints forwarded by ServerMili within 24 hours of notification.
- Cooperate with ServerMili in investigating suspected violations of this policy.
2. Prohibited Activities
The following activities are strictly prohibited on all ServerMili services. This list is non-exhaustive; ServerMili reserves the right to determine what constitutes a violation.
2.1 Illegal Activity
- Hosting, distributing, or linking to content that violates Indian law or the laws of any applicable jurisdiction.
- Child sexual abuse material (CSAM) — results in immediate termination and law enforcement referral.
- Operating fraudulent schemes, Ponzi schemes, pyramid schemes, or phishing operations.
- Selling or distributing illegal substances, counterfeit goods, or unlicensed pharmaceuticals.
- Identity theft, credit card fraud, or financial fraud of any kind.
2.2 Spam & Unsolicited Communications
- Sending unsolicited bulk email (spam), SMS messages, or other mass communications.
- Operating open mail relays, open proxies, or services designed to facilitate spam distribution.
- Email spoofing, forging headers, or manipulating identifiers to disguise the origin of messages.
- Harvesting email addresses or personal information from websites without consent.
2.3 Network Attacks & Security Violations
- Launching or participating in Distributed Denial of Service (DDoS) attacks.
- Port scanning, network probing, or vulnerability scanning of systems you do not own or have explicit authorization to test.
- Brute force attacks against any authentication system.
- Deploying, distributing, or hosting malware, viruses, trojans, ransomware, or exploit kits.
- Unauthorized access or attempted access to other users' accounts, servers, or data.
- Intercepting, monitoring, or sniffing network traffic not intended for your system.
2.4 Intellectual Property Violations
- Hosting pirated software, movies, music, games, or other copyrighted material without authorization.
- Operating torrent trackers, warez sites, or file-sharing services that primarily facilitate copyright infringement.
- Unauthorized use of trademarks, brand names, or logos in a manner that may cause confusion or deception.
2.5 Harmful Content
- Content that promotes terrorism, violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
- Content that violates the Information Technology Act 2000 and its amendments, including IT Act Section 66A, 67, 67A, and 67B.
- Doxxing, cyberstalking, harassment, or credible threats against individuals.
3. Resource Usage Limits
To ensure fair use and optimal performance for all customers, the following resource usage policies apply:
CPU & Memory
Shared hosting accounts must not consume excessive CPU or memory resources that degrade performance for other customers on the same server.
Disk & I/O
Disk space must be used for legitimate website content and data storage. Using shared hosting for file archiving, backup storage, or media streaming is prohibited.
Bandwidth
Bandwidth must be used for serving legitimate web content. Sustained high-bandwidth activities such as video streaming, large-file distribution, or CDN-like usage require a dedicated server or cloud instance.
Cryptocurrency Mining
Cryptocurrency mining is strictly prohibited on shared hosting and VPS platforms. Mining is only permitted on dedicated servers with prior written authorization from ServerMili.
Customers whose resource usage consistently exceeds fair limits will be contacted and asked to optimize their usage or upgrade to a more appropriate plan. If the issue is not resolved within 48 hours, the account may be suspended.
4. Email Policy
All email sent from ServerMili infrastructure must comply with the following guidelines:
- Consent: All recipients must have explicitly opted-in to receive your emails. Purchased or rented mailing lists are not permitted.
- Identification: Every email must clearly identify the sender with a valid physical address and a working reply-to address.
- Unsubscribe: Every marketing email must include a clear, functioning unsubscribe mechanism that processes requests within 48 hours.
- Volume Limits: Shared hosting accounts are limited to 200 emails per hour. Higher volume requirements must use a dedicated server or approved third-party email service.
- Authentication: All email-sending domains must be properly configured with SPF, DKIM, and DMARC records.
5. Reseller Responsibility
If you use ServerMili services for reselling (reseller hosting, VPS reselling, or dedicated server reselling), you are fully responsible for ensuring that your own customers ("end-users") comply with this AUP. Specifically:
- You must publish your own acceptable use policy that is at least as restrictive as this one.
- You must promptly act on abuse complaints related to your end-users' accounts.
- You are liable for any violations committed by your end-users.
- Failure to enforce compliance among your end-users may result in suspension or termination of your reseller account.
6. Enforcement & Consequences
ServerMili reserves the right to take any of the following actions in response to AUP violations, at our sole discretion:
Services terminated for AUP violations are not eligible for refunds. ServerMili is not liable for any data loss resulting from enforcement actions. We strongly recommend maintaining independent backups at all times.
7. Reporting Violations
If you become aware of any violation of this Acceptable Use Policy, please report it to us immediately:
8. Policy Updates
ServerMili reserves the right to modify this Acceptable Use Policy at any time. Material changes will be communicated via email to registered customers at least 30 days before the effective date. The latest version of this policy is always available on this page.
Continued use of ServerMili services after the updated policy becomes effective constitutes your acceptance of the changes. If you do not agree with the updated policy, you may cancel your services in accordance with our Terms of Service.
